tropical storm is barrelling towards texas at this hour and for once that's being greeted as good news. tropical storm don is in the gulf of mexico tracking towards the southern part of the lone star state. it's expected to make landfall tomorrow. fortunately, forecasters don't expect the storm to strengthen into a hurricane, but the area should get some desperately needed rain. up to one or two inches. meteorologist bill karins will have much more coming up shortly. sdmrimplts now here's a look at other stories making news early today in america. mother nature brought some rare unwelcomed storms to upstate new york tuesday. official advisory confirmed at least two tornadoes touched down, leaving trees uprooted and downed power lines in their wake. the unusual twisters measured as ef-0s, but they did produce strong enough winds to cause structural damage. >>> there was a concern in southern california after a train derailment let lead to the vakz of over 250 homes. at least 21 cars derailed, some carrying hazardous materials, which prompted the evacuation order. investigators didn

right now all systems point to go. today in texas and in washington, the white house and rick perry had a political fight to the death. in a dramatic down to the wire final hour fight at the supreme court over whether or not rick perry's texas would be allowed to kill a foreign citizen who the state of texas was holding prisoner. the man is a citizen of a foreign country, who was convicted of a murder in texas. he was never allowed any assistance from his home country. if you as an american are in a foreign country, and you are picked up and arrested, charged with a serious crime, the u.s. government has the right to intervene on your behalf to try to help you out. you don't get immunity if you have done something wrong, but you can get help from the united states because you are a united states citizen. that's not only a principle that americans count on if we think about leaving the country, it's also law. the vienna convention says we expect to be able to help americans arrested in foreign countries. and we will let foreign citizens arrested here get help from their government to

, texas, and what a sign of the economic times there today. a huge crowd lined up beginning last night for a chance to just fill out an application for federal housing assistance. when the line moved toward the building in the early hours of the morning after waiting all night, a stampede broke out. several people were injured in the crowd including a pregnant woman. this morning marked the first time in two years the dallas housing authority has accepted applications for section 8 housing vouchers. >>> also in the news tonight, our environment. now to what some are calling the great drought of 2011. the state of texas, for one, one of the 14 states suffering and sweltering through this disaster some have been comparing to the dust bowl of the 1930s, an epic drought the experts started tracking back in february. it hasn't stopped spreading and now covers just about the entire lower third of this country. water supplies are drying up, crops, cattle are dying and there's no relief in sight, sadly. nbc's tom trung is in waller, texas, just north of houston, tonight. tom, good evening. >>
